1. General

The booking of the mobile facilities is now more structured to allow the service provider to carry out the necessary risk assessments and health and safety checks as well as feasibility studies to ensure a high quality of planning and delivery throughout the borough of Erewash.

The Hiring Agreement is between you ("the hirer") and the mobile activities team at Erewash Borough Council (“the provider”). 

2. Bookings

  • All bookings are subject to a four week notice period to the delivery date, the hirer must provide a name and contact details as stated on the booking form.
  • Provisional booking forms will then be completed and returned to the hirer.
  • A site visit will then be carried out at the venue the hirer wishes to hold the delivery, including a risk assessment to determine if the site is fit for the delivery at question.
  • Bookings will then be confirmed with a futher comfirmation letter to the hirer, with details of the delivery along with the risk assessment.
  • The provider reserves the right to cancel or postpone any delivery which has not been met by the risk assessment or health and safety measures prior to the delivery.

3. Participation

  • Prior to using any equipment or structure within the facility you should check it for your safety and suitability for your purpose and skill level. If you find a temporary defect you should immediately inform a member of staff present.
  • The risk of injury from the activities involved in this facility is significant, including the potential for permanent disability or death, and while particular rules, equipment and self discipline may reduce the risk, the risk of injury does exist.
  • We do not accept any responsibility for loss/damage to any personal property
  • Any accident must be reported to the staff immediately
  • We reserve the right to refuse admission
  • No food or drink to be brought into the premises (unless in the allocated areas)
  • Parental consent must be completed in order to participate in the activities
  • Protective equipment provided by the mobile activity staff must be worn at all times
  • Should any member of staff decide at any time a participant is behaving inappropriately they reserve the right to remove this person from the facility
  • Any abusive, dangerous or anti social behavior will not be tolerated and removal/closing down of the site may occur.

4. The providers obligation

  • To provide activities and events to a high and professional standard, ensuring all equipment is fit for purpose and properly maintained in accordance with the description provided on the website
  • To take reasonable steps to address and properly and rectify as quickly any problems which arise before, during and after delivery of the service or hiring of the service
  • To ensure to mobile activities team act on information received on the consent formsi.e. medical, photos and collection of parents/guardians

5. Cost of hire

  • The Mobile Activities Funding from the National Lottery has come to an end and therefore we know charge for the use of our facilities. If you would like to find out the prices please get in contact with our Play Co-ordinator on 0845 907 2244 ext: 4318.
  • All provider costs will be based up on the current Erewash Borough Council Fees and Charges.

6. The Hirer’s obligation

  • Not to exceed the maximum number of participants agreed for the delivery of the event.
  • To ensure all health and safety actions agreed prior to the delivery are in place i.e. staff, barriers, car park closures etc
  • To ensure a contact person is present and available before, during and after delivery of the service
  • All consent forms completed through schools, clubs and associations are ready for the mobile activity staff to access for the delivery of the mobile activities
  • Not to share the allocated space with any other outside agency that is not part of the erewash mobile activities
  • To ensure no spectators or other hazards visible or present within the activity area.

7. Cancellation

The following may warrant a cancellations/postponements

  • Adverse weather conditions
  • Staff Vulnerability i.e. hotspot areas and no agency partnership support for the event
  • Staff illness/ injury /unforseen circumstances prohibiting delivery
  • Participant injury of a serious nature
  • Faulty equipment
  • Health and safety actions not carried out prior to the delivery
  • No participant uptake
  • Anti social behaviour occurring form participants/spectators

8. Data Protection

  • We will never collect sensitive information about you without your explicit consent
  • We will never disclose your details to any third party or transfer it anywhere
  • The type of information we collect is for monitoring purposes which includes Name, Address, Age, Phone number, email address etc.
